YSRI LLC (“EffiSim,” “we,” “us,” and “our”) provides an online marketplace that connects consumers (“Buyer(s)”) with providers of various products and merchandise (“Seller(s)”) to facilitate the purchase of such products or merchandise for on-demand delivery or pickup services. Our Privacy Policy is designed to help you understand how we collect, use, and share your personal information and to assist you in exercising the privacy rights available to you. It applies to our Buyers, Sellers, and any individual who may access the Platform and all references to “you” or “your,” as applicable, mean the person who accesses, uses, and/or participates in the Platform in any manner, and each of your heirs, assigns, and successors.

1. Scope.

This Privacy Policy applies to personal information processed by us during the course of business, including information processed on Effisim’s application for your mobile device (the "App"), our web site at Effisim.com (the "Site"), as well as all related web sites, networks, and downloadable software provided by us and on which a link to this Privacy Policy is displayed (collectively, together with the App and Site, our "Platform").

2. Personal information we collect.

The categories of personal information we collect depend on how you interact with our Platform. Personal information may include, but is not limited to, contact name, phone number, email address, physical address, credit card and other financial information, and product information, including product details and price.

2a. Information You Provide to Us

- Sign up and account information. If you create an account with EffiSim, we may collect your name, email address, address, credit card and financial information, and other relevant information.

- Order information. When a Buyer makes a purchase of a product or merchandise offered on the Platform by a Seller (a “Transaction”), we will collect and record the personal information and details associated with the Transaction. This may include, but is not limited to, your billing and shipping address, and payment information. Effisim does not directly collect or store any payment card information, but it may receive information associated with your payment card information including your billing details.

- Communications with us. We may collect your email address, phone number, mailing address, or any other relevant information when you request information about our Platform or a specific Transaction or otherwise communicate with us.

- Customer Service and Support. If you call or otherwise interact with EffiSim customer service and support, we may collect the information you provide us and we may record telephone calls between you and our representatives for training and quality assurance purposes

- Other communications with us. We may collect your personal information during various communications and interactions including, but not limited to: (1) Conferences, Trade Shows, and Other Events; (2) Business Development and Strategic Partnerships; (3) Employment Applications; (4) Surveys; (5) Participation in interactive features such as review forums; (6) Feedback. If you provide us with any information during any of these interactions with EffiSim, we will use it for the purposes for which it was collected.

2b. Information Collected Automatically

- Data Generated from Shopping with EffiSim. EffiSim may collect information that is generated during your interaction with the Platform, such as when you search or shop for products and when you complete a Transaction. EffiSim may collect data such as keywords, products you search for, data related to your search criteria, data on the Sellers that you browse, products that you view, products that you add to your cart, products that you place on your wish list, data related to your interests as discernable from your interaction with the Platform, and other information.

- Location and Sensor Information. We receive location information from Buyers, Sellers and other individuals who may access the Platform, including when the App is in use in the foreground or background. We may continuously collect location information and other motion-generated or orientation-generated mobile sensor data in order to personalize the App experience, to assist in finding available products, track the progress and completion of Transactions, and other similar purposes. We may also use this information for analytics purposes.

- Device Information. We may collect information related to the devices used by you to access or interact with the Platform, including your IP address, browser details, user settings, media access control (“MAC”) address, mobile operating system version, phone carrier and manufacturer, unique device identifiers, device type, cookie identifiers, mobile advertising, Internet service provider, pages that you visit before, during and after using the Platform, information about the links clicked, information about all Platform interactions, the frequency and duration of your activities, and other information about Platform use.

- Cookies, Pixel Tags/Web Beacons, and Analytics Information. We, as well as third parties that provide content, advertising, or other functionalities on the Platform may use “cookies,” pixel tags, local storage, and other technologies (“Technologies”) to automatically collect information through the Platform. Technologies are essentially small data files placed on your device that allow us and third parties to record certain pieces of information whenever you visit or interact with our Platform. We use these Technologies to understand how you navigate through and interact with the Platform, to learn about product popularity, for authentication and advertising purposes, and to save your preferences. Cookies are small text files that web servers place on your device; they are designed to store basic information and to help websites and apps recognize your browser. We may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be accessed every time you use our Platform. A pixel tag (also known as a web beacon) is a piece of code embedded in the Platform that collects information about Platform engagement. The use of a pixel tag allows us to record, for example, whether a user has visited a particular web page or clicked on a particular advertisement. We may also include web beacons in e-mails to understand whether messages have been opened, acted on, or forwarded.

- Analytics. We may use Google Analytics, Adobe Analytics and/or other service providers to collect and process analytics information on our Platform. 3. How we use this information.

We may use your personal information for a variety of business purposes, including, but not limited to:

3a. To provide the services and features, such as:

- To facilitate transactions, deliveries and payments;
- To analyze how you use our Platform;
- To fulfill a contract with you (i.e., fulfilling and managing your order);
- To process your payment by credit card and/or other financial information for products and services purchased; - To send you order updates via text message and/or other mediums;
- To respond to questions, comments, and other requests;
- To allow Platform functionalities and features; and
- To provide customer or technical support.

3b. For administrative or business purposes, such as:

- To fulfill business interests, such as direct marketing, research and development;
- To measure Platform engagement and develop statistics about Platform usage;
- To improve the Platform;
- To develop new products and services;
- To authenticate and verify individual identities;
- To carry out audits; and
- To communicate with you about your account, activities on our Platform and Privacy Policy changes.

3c. For security and safety purposes, such as:

- To maintain the safety, security, and integrity of our network, services, third parties, and Sellers and Buyers;
- To find and prevent fraud;
- To protect all Platform users and protect our business; and
- To provide account and network security.

3d. For legal and regulatory compliance purposes, such as:

- To resolve disputes;
- To enforce any legal terms that govern your use of the Platform;
- To pay our taxes or fulfill our business obligations; and
- To respond to requests by regulators, government entities, and official inquires.

3e. To market our products and services.

We may use personal information to tailor and provide you with content and advertisements. We may provide you with these materials as permitted by applicable law including, but not limited to, by email, telephone and text message (including via automatic telephone dialing system), direct mail, and custom audiences advertising. 4. Disclosure of information to third parties.

We may share your personal information with the following categories of third parties, which is a non-exhaustive list subject to change from time to time:

4a. Sharing between Buyers and Sellers.When you place an order through our Platform, you are instructing EffiSim to use and share your personal information to facilitate the completion of the Transaction for the products you have purchased. Once a Buyer’s personal information has been shared for this purpose, it will also be subject to the Seller’s privacy policy and the Seller may use your personal information for its own purposes, including to coordinate delivery of the products purchased or send you marketing materials. We encourage you to closely read the Seller’s privacy policy. Please note that we do not control and we are not responsible for the Seller’s processing of your personal information.

4b. Sharing with service providers. We may share any personal information we collect about you with our third-party service providers. The categories of service providers to whom we entrust personal information include service providers for payment and transaction processing, marketing and advertising, customer service activities, analytics and the provision of IT and related services.

4c. Sharing with business partners and affiliates. We may provide personal information to our business partners and affiliated entities to provide you with a product or service you have requested.

4d. Sharing with advertising partners. Through our Platform, we allow third party advertisers to set tracking tools and other technologies to collect information regarding your activities and your device. These include your IP address, cookie identifiers, page(s) visited, location, time of day. Our advertising partners may use this information (and similar information collected from other websites) for purposes of delivering targeted advertisements to you when you visit third party services within their networks. This practice is commonly referred to as “interest-based advertising” or “personalized advertising.” If you prefer not to share your personal information with third party advertising partners, please contact us.

4e. Sharing for the protection of the Platform or others. We may access, preserve, and disclose to external parties any information we store in association with you if we, in good faith, believe doing so is required or appropriate to: (i) comply with law enforcement, national security requests and/or legal process, such as a court order or subpoena; (ii) protect your, our, or others’ rights, property, or safety; (iii) enforce our policies or contracts; (iv) collect amounts owed to us; (v) respond to an emergency which we believe in good faith requires us to disclose information to assist in preventing the death or serious bodily injury of any person; (vi) assist with an investigation and prosecution of suspected or actual illegal activity; or (vii) investigate and defend ourselves or others against any third-party claims or allegations.

4f. Sharing for reasons of merger, acquisition, among others. If in the future, the Platform were to be involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, purchase or sale of assets, or transition of service to another provider, then your information may be sold or transferred as part of such a transaction, as permitted by law and/or contract.

5. International data transfers and consent to transfer.

All information processed by us may be transferred, processed, and stored anywhere in the world, including but not limited to, the United States or other countries. Our computer systems are currently based in the United States, so your personal data will be processed by us in the United States, where data protection and privacy regulations may not offer the same level of protection as in other parts of the world. If you create an account with the Platform as a visitor from outside the United States, by using the Platform, you agree to this Privacy Policy and you consent to the transfer of all such information to the United States, and to the processing of that information as described in this Privacy Policy or as otherwise permitted by law.

6. Children’s information.

The Platform is not directed to children under 13, and we do not knowingly collect personal information from children. If you believe that a child under 13 has provided us with personal information without your consent, you may contact us as set forth below.

7. Your choices with respect to privacy.

In addition to choices described in this Privacy Policy and as provided by law, you have other choices regarding your information:

7a. General. You may have the right to opt out of certain uses of your personal information such as by updating your profile information. Please note that you will need to separately contact Sellers to see what choices you may have regarding a Seller’s processing of your personal information.

7b. Email Subscriptions. You can always unsubscribe from our promotional emails via the link provided in the emails. Even if you opt out from receiving promotional messages from us, you will continue to receive administrative messages from us, including messages regarding Transactions. We may also send you certain non-promotional communications regarding us and our Platform, and you may not be able to opt out of those communications, including communications regarding updates to our Terms of Service or this Privacy Policy.

7c. Location Information. While you can prevent your device from sharing location information at any time through your device’s operating system settings, location is core to our Platform and without it, you may not be able to successfully use our Platform.

7d. Text Messages. You may opt out of receiving text messages by replying “STOP” to a text message you have received from us or by otherwise contacting us.

7e. Mobile Devices. We may send you push notifications through our App. You may at any time opt out from receiving these types of communications by changing the settings on your mobile device. With your consent, we may also collect precise location information if you use our App. You may opt out of this collection by changing the settings on your mobile device.

7f. Account Deletion. If you choose to delete your account, we may retain certain information to collect any fees owed, resolve disputes, troubleshoot problems, analyze usage of the Platform, assist with any investigations, prevent fraud, enforce our Terms of Service, or take other actions as required or permitted by law and/or regulations.

7g. Advertisement and cookies. You may stop or restrict the placement of Technologies on your device or remove them by adjusting your preferences as your browser or device permits. Please note that cookie-based opt-outs are not effective on mobile applications. However, you may opt-out of personalized advertisements.

The online advertising industry also provides websites from which you may opt out of receiving targeted ads from data partners and other advertising partners that participate in self-regulatory programs. 8. Data retention.

We store the personal information we receive as described in this Privacy Policy for as long as you use our Platform. We may also keep personal information as necessary to fulfill the purpose(s) for which it was collected, including but not limited to resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws.

9. Data security.

We are committed to protecting your information and take steps to ensure that your information is treated securely and in accordance with this Privacy Policy. We use various measures to safeguard your personal information against loss, theft, unauthorized access, use and/or modification. Unfortunately, no system is 100% secure, and we cannot ensure or warrant the security of any information you provide to us. While we do our best to protect your information, you are also responsible for protecting your information by, for example, protecting your account credentials. If you have any reason to believe that your account has been compromised, please notify us immediately. To the fullest extent permitted by applicable laws, we do not accept liability for unauthorized disclosure. If we learn of a security system’s breach, we may attempt to notify you electronically by posting a notice on the Platform or by mail or by sending an email to you.

10. Third party websites and applications.

Our Platform may contain links to other websites, products, or services that are beyond our control. Parts of the Platform may also include third-party integrations such as Google Maps features and content, including the Google Maps API(s). Your use of these services is subject to their respective privacy policies, such as the Google Privacy Policy. Please be aware that we are not responsible for the privacy practices of such third parties. We encourage you to read their privacy policies before giving them your information. We do not endorse, screen, review or approve these policies, and are not responsible for the privacy practices or content of such other websites or applications. Providing personal information to third-party websites or applications is at your own risk.

11. Privacy Information for California Residents.

For purposes of the California Consumer Privacy Act, we do not “sell” your personal information.

Under the California Consumer Privacy Act (“CCPA”), as may be amended from time to time and subject to exceptions, California residents may have specific rights regarding their data, including:

- The right to know the categories of personal information collected during Platform interactions;
- The categories of sources from which the personal information was obtained;
- The right to know the business purposes for sharing personal information;
- The right to know the categories of third parties with whom we’ve shared personal information;
- The right to access the specific pieces of personal information we’ve collected;
- The right to delete your personal information that has ben shared;
- The right to opt out of having your personal information sold.

If you would like to exercise any of these rights, please contact us as set forth below. We will process such requests in accordance with applicable laws. California residents have the right not to receive discriminatory treatment by EffiSim for the exercise of their rights conferred by the CCPA. Please note that if you wish to exercise any of your rights with a Seller, you must contact the Seller directly.

12. Nevada Residents.

Under Nevada law, certain Nevada consumers may opt out of the sale of “personally identifiable information” for monetary consideration to a person for that person to license or sell such information to additional persons. “Personally identifiable information” includes first and last name, address, email address, phone number, Social Security Number, or an identifier that allows a specific person to be contacted either physically or online. We do not engage in such activity. However, if you are a Nevada resident who has purchased goods on our Platform and you would like to exercise any of right available to you by law, please contact us as set forth below.

13. Changes to our Privacy Policy.

We may revise this Privacy Policy from time to time in our sole discretion. If there are any changes to this Privacy Policy, we will revise the “Last Updated” date at the top of this Privacy Policy or we will notify you as required by applicable law. You understand and agree that you will be deemed to have accepted the updated Privacy Policy if you continue to use the Platform after the new Privacy Policy takes effect. We encourage you to read this Privacy Policy periodically to stay up-to-date about our privacy practices.
